Gift Card Policy

Purchasing, receiving, or using the Card constitutes agreement to all of the following: Forum Health prepaid cards (“Cards”) are prepayments of goods and/or services available from Forum Health clinics, and are fully transferrable but remain subject to these terms and conditions. Except as provided below or required by law, the balance on your Card is nonrefundable, may not be redeemed for cash, is not insured by the federal deposit insurance corporation and does not earn interest. This Card cannot be used in conjunction with or to purchase any medical treatment or product that is reimbursable or covered by third party insurance, and you agree not to submit any amount paid for with the Card for reimbursement by any third party insurance. The availability of services varies by Forum Health clinic location.   

 

Cards will be delivered in a downloadable and printable electronic format (PDF) and will typically be activated within one day after purchase. The recipient of the Card must allow for e-delivery and is responsible for accurate recipient information and email (e.g. spam) settings. Cards generally expire 5 years from issuance, but are subject to state laws and regulations applicable to each Card. Cards may be used as cash, and you are responsible for any charges made with your Card. Forum Health is not responsible for unauthorized Card use, or for any lost or stolen Card. 

 

Class Action Waiver and Jury Trial Waiver: 1) Any proceeding, whether in arbitration or in court, will be conducted only on an individual basis and not in a class, collective, consolidated, private attorney general, or representative action. 2) All parties waive any right to bring or to participate in such an action in arbitration or in court to the fullest extent allowable by applicable law, except the parties retain the right to participate in a class-wide settlement. 3) To the fullest extent allowable by applicable law, all parties waive the right to a jury trial. 

 

Any and all disputes related to use of the Card shall be governed by Delaware law, and will be under the exclusive jurisdiction of Delaware state and federal courts. Objections to venue due to inconvenience or any other basis or right to transfer are waived.  

 

As a purchaser and/or holder of the Card, you will receive communications about goods and/or services provided by Forum Health. Forum Health Card use constitutes acknowledgement of these Terms and Conditions and the Forum Health Privacy Policy, Terms of Use, and Notice of Privacy Policies found on the Forum Health website, all of which may be updated at any time and from time to time by Forum Health.
